1. About these terms
These Terms and Conditions govern your booking and use of services at Cheatcode Playground. By making a booking, purchasing a session or package, or attending a session, you agree to these terms.
Cheatcode Playground is a recovery and performance centre. It is not a medical or therapeutic services provider. Please read Section 8 (Health and screening) and Section 9 (Not medical treatment) carefully before booking.
We may update these terms from time to time. The version in effect at the time of your booking applies to that booking. The current version is always available at [URL].
2. Bookings
2.1 How to book
Bookings are made through our client portal at my.cheatcodeplayground.com, or in person at the clinic.
2.2 Payment is required to confirm a booking
All online bookings must be paid in full at the time of booking. A booking is not confirmed until payment is received. Unpaid bookings are not held.
Payment is processed by our payment provider. We do not store your full card details.
Walk-in bookings made in person at the clinic may be paid at the counter at our discretion.
2.3 Your account
To book online you need a client account. You are responsible for keeping your account details accurate and your password secure, and for all bookings made through your account.
2.4 First Run requirement
New clients are required to complete a First Run session before booking other session types. The First Run establishes your baseline, introduces you to the devices, and allows our staff to identify anything that affects how your later sessions should be run.
3. Cancellations
3.1 More than 24 hours before your session
You may cancel a booking at any time up to 24 hours before your scheduled session start time and receive a full refund.
Refunds are returned to your original payment method. Processing times are set by your bank or card issuer and are outside our control.
3.2 Less than 24 hours before your session
A session cancelled less than 24 hours before its scheduled start time is charged in full and is not refunded.
We hold a room, a device, and a staff member for your session. Inside 24 hours we cannot reasonably fill that slot.
If you cannot attend, rescheduling costs you far less than cancelling. See Section 4.
4. Rescheduling
4.1 More than 24 hours before your session
You may reschedule at any time up to 24 hours before your scheduled session start time, free of charge, through the client portal.
4.2 Less than 24 hours before your session
You may reschedule inside the 24-hour window on payment of a $15 late reschedule fee.
The fee is payable at the time you reschedule. Your new session time is not confirmed until the fee is paid. Rescheduling is completed through the client portal at my.cheatcodeplayground.com. If you contact us by phone, our staff will direct you to the portal to complete the change.
Your original session payment carries across to the new booking. The $15 fee is in addition to that payment and is not refundable.
5. No-shows
If you have not arrived 15 minutes after your scheduled session start time, your booking is recorded as a no-show and charged in full. No refund is available.
6. Late arrival
We hold your session for 10 minutes past its scheduled start time. If you arrive within that window, your session runs its full length wherever the day's schedule allows.
If you arrive more than 10 minutes late, your session will be shortened so that it finishes at its original scheduled end time. The room and device are booked for the next client immediately afterwards and we cannot run over. You are charged the full session price.
If you arrive more than 15 minutes late, your booking has already been recorded as a no-show under Section 5. Whether we can still run a shortened session depends on the day's schedule, and is at our discretion.
7. Packages and gift cards
7.1 Expiry
Packages and gift cards expire 12 months from the date of purchase. Sessions or value remaining after that date are forfeited.
7.2 Transferability
Gift cards are transferable, packages are not.
7.3 Refunds
Packages and gift cards are not refundable except where required by the Australian Consumer Law (see Section 13).
7.4 Bookings made using a package
Sessions booked using package credit are subject to the same cancellation, rescheduling, no-show and late-arrival terms as any other booking. A session cancelled inside 24 hours consumes the package credit.
8. Health and screening
8.1 Screening is required
Before your first session you must complete our health screening. You must answer honestly and completely. The screening exists to identify conditions that make a device or protocol unsuitable for you.
8.2 Contraindications
Some health conditions make one or more of our devices unsuitable. Depending on your answers, we may:
decline to provide a particular device or protocol;
require written clearance from your doctor before you attend; or
decline to provide services at all.
These decisions are made in the interest of your safety and are at our discretion.
8.3 Changes to your health
You must tell us if your health changes between sessions. This includes new diagnoses, new medications, pregnancy, recent surgery, recent seizure activity, or any new symptom you would mention to a doctor. If your health changes materially, we may ask you to complete screening again.
8.4 If you disclose something during a session
If you disclose a condition during a session that would have changed our assessment, we may stop the session. Where a session is stopped for a safety reason, we will discuss the fairest outcome with you at the time.
8.5 Doctor's clearance
Where we ask for clearance from your doctor, we cannot provide the relevant service until we have received it. Obtaining clearance is your responsibility and any cost is yours.
9. Not medical treatment
Cheatcode Playground is a recovery and performance centre, not a medical or therapeutic services provider.
Our sessions, devices and protocols are not intended to diagnose, treat, cure or prevent any medical condition or disease. Nothing said to you by our staff, published on our website, or contained in our materials constitutes medical advice.
Results vary between individuals. If you have a medical condition or health concern, consult a qualified healthcare professional before using our services and continue any treatment they have prescribed. Do not stop or change prescribed treatment on the basis of anything you experience at Cheatcode Playground.
Statements about our services have not been evaluated by the Therapeutic Goods Administration.
10. Clients under 18
Clients under 18 years of age may attend only with the written consent of a parent or legal guardian.
A parent or guardian must:
complete the health screening on the young person's behalf;
accept these terms on their behalf; and
For under 16s, a guardian must be on the premises for the duration of the minor’s session; for 16s – 18s, guardian’s presence is at the guardian’s discretion.
Some devices and protocols are not available to clients under 18 regardless of consent.
11. Conduct
We want the space to be calm and safe for everyone in it. We may refuse service, end a session, or ask you to leave where:
you attend under the influence of alcohol or drugs;
you behave in a way that is aggressive, threatening, abusive or harassing toward our staff or other clients;
you damage or misuse our equipment or premises;
you ignore safety instructions given by our staff; or
you attend with a condition you were asked to disclose and did not.
Where service is refused or a session is ended for any of these reasons, the session is charged in full and no refund is available.
We may decline future bookings.
12. Privacy
We collect and handle personal information, including health information, in accordance with our Privacy Policy, available at https://www.cheatcodeplayground.com/privacy.
The health screening you complete before your first session, any contraindications recorded, and any doctor's clearance we receive are health information for the purposes of the Privacy Act 1988 (Cth) and are handled accordingly.
By booking, you consent to us contacting you about your bookings — confirmations, reminders, changes, and receipts. These are operational messages and are sent regardless of any marketing preference. You may opt out of marketing communications at any time without affecting your bookings.
13. Australian Consumer Law
Nothing in these terms may exclude, restrict or modify the consumer guarantees under the Australian Consumer Law. Sections 3, 5, 6, 7 and 11 all impose charges or forfeitures and each needs to be tested against the unfair contract terms regime, which applies to standard-form consumer contracts and was significantly strengthened in November 2023. The penalty exposure for an unfair term is now substantial. The $15 late reschedule fee and the full-charge cancellation term are the two most likely to attract attention: both should be defensible as a genuine pre-estimate of loss rather than a penalty, and the drafting should reflect that.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Where our services fail to meet a consumer guarantee, you are entitled to a remedy under the Australian Consumer Law. Where the failure is major, you may be entitled to cancel and obtain a refund. Where the failure is not major, we may choose to re-supply the service.
14.1 The Australian Consumer Law comes first
Nothing in this Section 14 excludes, restricts or modifies any guarantee, right, warranty or remedy you have under the Australian Consumer Law or any other law, to the extent that it cannot lawfully be excluded, restricted or modified.
This Section 14 applies only to the extent the law permits. If any part of it would otherwise be void, unenforceable or in breach of the Australian Consumer Law, that part is to be read down to the minimum extent necessary, or severed, without affecting the rest of these Terms.
Section 13 (Australian Consumer Law) sets out the guarantees that apply to our services and cannot be excluded.
14.2 What we are responsible for
We are responsible for providing our services with due care and skill, using devices that are fit for the purpose for which they are supplied, and in accordance with the guarantees that apply under the Australian Consumer Law.
We take reasonable care in:
assessing your health screening and identifying contraindications;
selecting and running protocols appropriate to the information you have given us;
maintaining and operating our devices in accordance with the manufacturer's specifications; and
keeping our premises safe.
14.3 Where our liability is limited
Subject to clause 14.1, and to the maximum extent permitted by law:
(a) Consequential and indirect loss. We are not liable to you for any indirect, consequential, special or incidental loss or damage, or for any loss of profit, loss of revenue, loss of opportunity, loss of anticipated saving, loss of data, or loss arising from business interruption, however caused, whether in contract, tort (including negligence), under statute or otherwise, and whether or not we were advised of the possibility of that loss.
(b) Cap on liability. Where we are liable to you and that liability may lawfully be limited, our total aggregate liability to you in connection with a session or a purchase is limited, at our option, to:
(i) re-supplying the relevant service; or
(ii) refunding the amount you paid for the relevant service.
(c) Third-party manufacturers. Our devices are manufactured by third parties. Where a loss arises from a defect in a device rather than from the way we selected, maintained or operated it, our liability is limited to the extent the loss is caused by our own act or omission. This clause does not affect any right you have against a manufacturer or importer under the Australian Consumer Law.
(d) Personal property. We are not liable for loss of or damage to personal belongings brought onto our premises, except to the extent the loss or damage is caused by our negligence.
14.4 Personal injury
Subject to clause 14.1 and to the maximum extent permitted by law:
(a) We are not liable for injury, illness, aggravation of an existing condition, or adverse reaction arising from a condition, symptom, medication, treatment or circumstance that you did not disclose to us, or that you disclosed inaccurately or incompletely, whether at screening or afterwards, where disclosure would have caused us to alter or decline the service.
(b) We are not liable for any consequence of your failure to follow a safety instruction given by our staff, or of your attending a session under the influence of alcohol or drugs.
(c) Nothing in this clause limits our liability for death or personal injury caused by our own negligence, to the extent that liability cannot lawfully be limited.
14.5 Specific risks you acknowledge
You acknowledge that you have been informed of, and accept, the following risks. These are inherent in the services and are not the result of any failure of care on our part.
(a) Stroboscopic light. The roXiva RX1 produces rapid flashing light. Flashing light can trigger a seizure in a person with photosensitive epilepsy or an undiagnosed photosensitivity, and can cause dizziness, disorientation, nausea, headache or visual disturbance in a person with no such history. You must not use this device if you have a history of seizures, epilepsy or photosensitivity unless you have given us written clearance from your doctor.
(b) Whole-body vibration. The Shiftwave chair delivers whole-body vibration and low-frequency sound. Vibration is contraindicated for a range of conditions including, without limitation, pregnancy, recent surgery, acute injury, deep vein thrombosis, certain implanted medical devices, and some cardiovascular and spinal conditions. You must disclose any of these before your session.
(c) Emotional and psychological response. These modalities are designed to alter your nervous system state, and can produce strong, unexpected or unfamiliar emotional responses — including in people with no history of them. This may include distress, involuntary emotional release, the surfacing of difficult memories, or a period of feeling unsettled after a session. This is a known and foreseeable feature of the services, not a malfunction. If you have a psychiatric or psychological condition, or are under psychological or psychiatric care, tell us at screening and consult your treating practitioner before booking.
(d) Individual variation. Responses to all three devices vary between individuals and between sessions for the same individual. We do not promise any particular outcome, benefit, result or level of improvement, and no statement made by our staff, on our website, or in our materials should be understood as such a promise.
(e) After your session. You may feel drowsy, disoriented, emotionally activated or unusually relaxed after a session. You are responsible for deciding whether you are fit to drive or operate machinery afterwards. If you are unsure, wait, or arrange other transport.
14.6 Not medical treatment
You acknowledge that Cheatcode Playground is a recovery and performance centre and not a medical or therapeutic services provider, that our services are not intended to diagnose, treat, cure or prevent any medical condition or disease, and that nothing provided to you by us constitutes medical advice.
We are not liable for any loss arising from your reliance on our services as a substitute for medical or psychological care, or from your stopping, reducing or altering treatment prescribed to you by a qualified healthcare professional.
Section 9 of these Terms sets out this position in full.
14.7 Your obligations affect our responsibility
Our ability to provide the services safely depends on the accuracy and completeness of the information you give us. To the maximum extent permitted by law, our liability is reduced to the extent that a loss is caused or contributed to by:
your failure to disclose, or inaccurate disclosure of, information required at screening (Section 8.1);
your failure to tell us of a material change in your health between sessions (Section 8.3);
your failure to follow a safety instruction; or
your own negligent act or omission.
14.8 Matters outside our control
We are not liable for any failure or delay in providing the services caused by an event beyond our reasonable control, including equipment failure, power outage, loss of network or system availability, fire, flood, storm, pandemic, public health direction, industrial action, or the act of any third party.
Where a session cannot proceed for such a reason, we will offer you a rescheduled session or a refund of the amount you paid for that session. This is your sole remedy in those circumstances, subject to clause 14.1.
14.9 Time limit for claims
To the maximum extent permitted by law, you must notify us in writing of any claim in connection with a session within 12 months of the date of that session.
14.10 Survival
This Section 14 survives the termination or expiry of these Terms and continues to apply to any session provided before termination.
15. Changes to these terms
We may update these terms. The version in effect at the time you make a booking governs that booking. Material changes will be notified through the client portal or by email.
16. Governing law
These terms are governed by the laws of Queensland, Australia. You and Cheatcode Playground submit to the non-exclusive jurisdiction of the courts of that State.
